Defense rests without testimony from Edwards or his mistress

The defense in the John Edwards corruption trial rested on Wednesday morning in Greensboro, N.C., without calling the former presidential candidate, his daughter Cate or Rielle Hunter, his former mistress, mother of his 4-year-old love child and the woman at the center of the scandal that spawned the federal case against him.

According to MSNBC, “crowds had lined up two hours before court opened … anticipating they might get an opportunity to hear from the principal players.”

But Judge Catherine Eagles told jurors that no more witnesses would be called to testify at the trial, now in its 18th day. Closing arguments are expected to begin Thursday. Jury deliberations will follow, likely on Friday.

Edwards faces six criminal counts?including conspiracy, four counts of receiving illegal campaign contributions and one count of making false statements?for allegedly soliciting and secretly spending over $925,000 to cover up his affair with Hunter during the 2008 presidential election. If convicted on all six counts, Edwards faces up to 30 years in prison and $1.5 million in fines.

Prosecutors spent nearly three weeks delving into the salacious details of Edwards’ affair. Lawyers for Edwards began presenting their case on Monday by shifting attention to something entirely less sexy: campaign finance law.

On Tuesday, records introduced at trial showed that Hunter was given $9,000 a month in cash for living expenses by Edwards’ campaign finance chairman, Fred Baron, in 2008.

Baron began making regular deposits into Hunter’s checking account in June 2008. Edwards, who by then had already ended his presidential bid but still had hopes of running for vice president, was trying to hide Hunter from public view. Lawyers for Edwards say the money was a personal donation unrelated to the campaign. Baron died in December 2008.

Cate Edwards Upton, a 30-year-old lawyer, had been expected to testify on her father’s behalf. It was unclear whether Hunter, who was on the witness lists for the prosecution and defense, would be called.

In the end, it seems lawyers for Edwards concluded that putting Hunter or the candidate himself on the witness stand was just too risky.

Edgar Wright Hopes to Film Ant-Man This Year

Fans have been curious about Marvel?s Ant-Man for quite some time.? Edgar Wright is attached to direct, and he?s been working on the script for the past few years alongside Attack the Block?s Joe Cornish.? The Avengers made an insane amount of money, so all eyes are on what Marvel Studios has coming up. Marvel president Kevin Feige recently revealed that there are two unannounced Marvel projects currently in development, in addition to Iron Man 3, Thor 2, and Captain America 2.? With word that Ant-Man was coming along nicely, many were hoping that the superhero pic would be Wright?s next film.? However, the director recently set a September start-date for a third film with Simon Pegg and Nick Frost called The World?s End.

Confirmation that The World?s End is finally happening was fantastic news, but fans were left wondering what that meant for Ant-Man.? Wright recently appeared on Empire?s podcast and he talked a bit about fans being impatient regarding Ant-Man.? Hit the jump for more.

?I get quite superstitious because I don?t feel like anybody ? websites and stuff ? quite understands how hard long it takes and because the film websites update hourly, it?s like ?What?s the fucking hold up? Just make it. Why isn?t it coming out tomorrow??? But every film that I?ve made has taken like three years. Each one, it?s been three years between movies. I would love for that gap to be shorter, but the truth is there?s ? it?s almost like a holding pattern. There are planes in the air and you have to figure out which one is going to land before they all crash.?

It?s a fair point, and as long as Wright is committed to doing the project at some point, I feel like fans should have faith that he?ll get to it when it?s ready.

?Yes, things are happening and other things are happening on other things as well. ? There?s some interesting plates spinning and I ideally hope we?ll be shooting this year.?

ant-man-movieWhen Steve talked to Feige about Ant-Man, the Marvel president said to pay attention to Wright?s tweets ?in the coming months.?? Sure enough, Wright himself tweeted an Ant-Man tease last week.

When we learned about the start-date for The World?s End, the report stated that plan is to have the film ready for a possible spring 2013 release.? That would certainly free Wright up for the remainder of next year, and assuming no other project takes priority (he?s developing The Night Stalker with Johnny Depp), Ant-Man could very well be underway before the end of 2013.? Feige recently stated that Marvel plans to release two films a year from here on out, and there?s currently an untitled Marvel pic slated for May 2014.

If that date is earmarked for Ant-Man, then fans only have to wait a short while longer until Wright?s superhero flick is in theaters.? However, if Ant-Man doesn?t make that release date or is pushed to 2015, I think we should all give Wright a break.? All of his films are excellent, and if he keeps pumping out supreme quality features then there?s no reason to grow impatient.? Things could be much worse, folks.? At least he?s not on a Terrence Malick schedule.

Fotolia scores $300m in equity, debt financing from PE firm KKR in exchange for 50% stake

First stock imagery site Shutterstock files for a $115 million IPO, and now rival Fotolia is selling 50 percent (note: link goes to a paywalled Financial Times article) of the company to private equity firm Kohlberg Kravis Roberts & Co. (KKR).

KKR, which has over $62 billion in assets under management, is pumping $150 million in growth equity investment into the digital stock photo giant.

Furthermore, the PE firm teamed up with previous Fotolia backer TA Associates, Fotolia management, KKR Capital Markets and a number of banks to provide an additional $150 million in senior (debt) financing for the company.

According to the FT, that gives Fotolia an enterprise value of $450 million.

For your background: competitor Getty Images was acquired by another private equity group, Hellman & Friedman, in a transaction valued at an estimated $2.4 billion back in 2008.

Founded in 2005, Fotolia has become the largest stock imagery site in Europe by a margin, boasting a catalog of over 17 million images and videos that can be licensed by customers worldwide. Thousands of photographers and designers are said to upload thousands of new images and videos onto Fotolia?s platform every day.

Fotolia, which is actually headquartered in New York these days, received its first growth investment from TA Associates in 2009 (worth between $50 million and $100 million according to the FT).

Earlier this year, the company acquired Wilogo, a crowd-sourced design community. Last year, Fotolia co-invested in US-based stock audio site AudioMicro.

Why Howard Stern Is The Perfect ‘America’s Got Talent’ Judge

Settle down, America.

Regardless of what you think of segments like “Hottest Chick with the Oldest Dude” or the “Tiger Woods Mistress Beauty Pageant,” new “America’s Got Talent” judge Howard Stern is not going to bring his X-rated antics to prime-time television.

Stern starts his run as a judge on the popular reality competition
 show on Monday (May 14) night and before viewing even one minute of his family-hour act some critics have already decided he’s going to turn the 8 p.m. hour into a non-stop cavalcade of strippers, four-letter words and bathroom humor.

If you’ve listened at all to Stern’s SiriusXM radio show over the past six months, the original radio rebel has made it clear that he has only one intention: to be the best, most honest judge on TV.

Stern is an obsessive about many things: his career-long nemesis Don Imus, his quirky bathroom habits, babysitter porn, the weight gains and losses and internecine feuds among his staff members and, yes, judges on reality series. As much as he’d love to find better uses for his time, Howard is drawn like a magnet to “American Idol,” “Dancing With the Stars” and various other shows where, frankly, he thinks the judges are lousy, lazy, dishonest and just kind of lame.

“AGT” is Stern’s chance to prove that he is willing to put up or shut up. This is the man, you may recall, who has spent decades trying to convince America that he is a poorly endowed, paunchy lover who has never satisfied a woman. How much more honest can you be?

He knows better not just as a father of three seemingly well-adjusted adult daughters, but as a professional broadcaster and 30-plus year veteran in the game. There’s a time and a place for everything and “AGT” is not the forum for the Wack Pack and the adult word of Stern. This is a guy, after all, whose first movie was a hit, but who has spent the ensuing 20-plus years reading scripts and discarding them because they didn’t ring true or feel right for him. Every move he makes is meticulously dissected, over-thought and ruminated over both on and off the air. The neurotic, locker room Howard Stern character of the radio is not the same Howard you are going to see on TV.

Because who in their right mind would humiliate a child on TV as some have suggested Stern might do? If anything, given his moral compass, Howard is more likely to go after the greedy, self-involved “Toddlers and Tiaras”-style parents that put their children up to audition for transparently selfish reasons. And who could argue with that? That’s not even mentioning the fact that “AGT” picked up the entire production and moved it to New York to accommodate Stern’s radio show. Combine that with a reported $20 million payday, and, let’s assume, an iron-clad morals clause, and there’s virtually no incentive for Stern to go off-script and try to tank the show by crossing streams with his more sordid radio world.

Why would Stern spend his life building a brand, only to go on TV and pull some kind of Andy Kaufman stunt and blow it apart just to be shocking? That’s not shocking. That’s self-destructive, bad business and frankly, just stupid.

If there’s anything I’ve learned after listening to Stern for the past two decades it’s that he will pick fights with management and complain and lash out, he will stomp his feet, vent his spleen and complain ad nauseum about being treated poorly, but he will not embarrass himself or do anything that could tarnish the legacy of what he’s so painstakingly built for himself and his audience. (Okay, Fartman was not his best moment, but still, c’mon, it was still pretty hilarious.)

He wants you to love him, needs you to love him and after hit radio shows, movies, books and television production credits, what better way to do that than to once again prove his detractors wrong and conquer the one medium he’s got left on his bucket list: star of prime time TV?

Plus, he loves to win, lives to win, and he knows that with this move he can’t lose. There’s little or no competition from other big-name shows in the summer months, the program already has a huge ratings base and any drop-off from the Stern Effect will easily be made up by his millions of fans. The curiosity factor alone (not to mention a huge, full-court ad campaign that had the normally press-averse Stern doing talk shows and New York Times interviews) will surely give the first few weeks a major ratings boost.

After years of experiments, plugging a celebrity judge into a panel is a mixed blessing at this point. Steven Tyler was kind of fun and quirky on last year’s “American Idol,” but by this season he was merely irritating and mostly just a peacocking place-filler who offered little or nothing of substance to the contestants.

Howard’s watched this, studied it and has promised that he will be a different kind of judge. “All these articles talk about how I’ve changed and I’m like, ‘Good, I hope I’ve changed,’” Stern said on his satellite radio show on Monday (May 14) about his bad-boy reputation. He’s less angry, jealous and resentful these days, but he’s also more keenly aware of what it takes to entertain and I have a feeling that, love him or hate him, if you tune in tonight you’re going to be surprised. And I guarantee you will be entertained.

Apple’s iPad gives you numerous ways to take notes, from typing on the virtual keyboard to writing on the touchscreen with a stylus or your finger. The note-taking app Penultimate (99 cents), recently purchased by the note-syncing and storage app company Evernote, is one of the best iPad note-taking apps around. It’s fast, friendly, flexible, and at less than a buck, a bargain, all reasons it’s an Editors’ Choice. Using the app is second nature because it’s nearly the same as doodling in a paper notebook. While the app’s touch-based sophistication will no doubt impress consumers, when paired with a touch stylus like the Kensington Virtuoso ($24.99), Penultimate can scale to the professional demands of engineers, architects, and industrial designers. Not to mention that the app is optimized for the new iPad’s high-resolution retina display.

The Penultimate iPad app doesn’t have a keyboard, so it’s not useful for typing notes. And it isn’t quite as feature-rich as our other Editors’ Choice Note Taker HD ($4.99, 4.5 stars)?although the latter costs five times as much. (For more recommendations, see “Note-Taking Apps for the iPad.”)

Broad Strokes
Penultimate’s interface looks familiar, though if there’s any uncertainty, an interactive walkthrough takes just a couple of minutes to complete. You write in a virtual notebook, filled with blank, grid, or lined pages. The tools, a pen?fine, medium, or broad tipped, in ten shades?and eraser follow your finger or stylus across the page. New pages appear when you flip forward by touching the top corner of a page. Flipping between pages is nearly as smooth as thumbing the pages of a physical book, a testament to the app’s speed.

Also worth mentioning are two controls through which you can improve usage. From the settings,you can move the toolbar?buttons for clearing a page, writing, and erasing?from the bottom of a page to the top. There’s also a clever feature called Wrist Protection, which, automatically disregards stray marks from a resting wrist. Sometimes, especially when doodling, Wrist Protection can be overly protective, ignoring quick swipes, but when it comes to writing, it’s a must.

Finger Painting
Penultimate organizes your work in terms of “Notebooks.” Accessing different notebooks is as easy as returning to “My Notebooks” and swiping through the covers. Inside a notebook, you can create as many pages as you like. Unlike a notebook that comes in one style?blank, lined, or grid?with Penultimate, you can alternate between the three paper background styles. An in-app connection to The Paper Shop allows you to buy additional paper styles, such as sheet music paper, should you choose. A few are free, but most cost about a dollar.

If you make mistakes, as you will at first while getting used to writing with your finger or a new stylus, you can use either an eraser or an “undo” button. Multiple undos are supported, thankfully, and a redo button lets you toggle back if you undo too many actions.

The Penultimate iPad app doesn’t have handwriting-to-text OCR, as the app Notes Plus ($7.99) does. So if you write by hand, the text stays in your handwriting, for better or worse. The iPad display doesn’t tent to make handwriting look any worse than it already is, and if anything, smooths it slightly. Penultimate is fine for quick notes, and amazing for sketching or mind-mapping, but we wouldn’t recommend it for heavy writing.

Art Gallery
Whether you’re sharing in real time through a projector, distributing sketches as PDFs, or backing up files in iTunes, Penultimate is a capable companion. If you’re looking to collaborate with colleagues, you can connect your pad to a projector via the Apple iPad VGA Adapter ($29). You can also share sketches via email. From inside a notebook, you can select either page or a full notebook to be attached as either a standard PDF or the proprietary .pen format.

Exported PDFs look great. There’s even an option to include the paper background image, or convert it to flat white. You can import image files into your notebooks and mark them up with notes or just place them on a page and resize them however you want. Penultimate integrates well with Dropbox, Evernote (Penultimate is now owned by the company Evernote), and iTunes.

Your Last Pen
Penultimate for iPad, a PCMag Editors’ Choice, is an excellent and ridiculously inexpensive note-taking app that is especially handy for those who have to sketch diagrams and images in their notes. Typists will lament the lack of a keyboard and should stick to Note Taker HD, our other Editors’ Choice, instead. Tight integration with Dropbox and Evernote, two big players in the cloud syncing space, given Penultimate a little more utility than it would otherwise have on its own. Now that the product has been picked up by Evernote, we’re excited to see what’s in store next for this capable and already impressive app.
